Prof. Githu Muigai, SC, C. Arb is an esteemed litigator, a proficient as well as highly regarded Arbitrator based in Nairobi and the Founding and Senior Partner of Mohammed Muigai LLP. He holds an LLB and a PhD from the University of Nairobi, an LLM from the Colombia University Law School and a Diploma in law from the Kenya School of Law and was admitted to the Kenyan Bar in 1985 and conferred the rank of Senior Counsel by the President of the Republic of Kenya in 2013. He was the 6th Attorney General of the Republic of Kenya serving under two (2) Presidents from 2011 to 2018.
Prof. Githu Muigai SC has very broad international and domestic experience at dispute resolution having represented Kenya as the Attorney General before the International Criminal Court at the Hague. He has represented numerous parties at the Supreme Court of Kenya, the Supreme Court of Uganda and other regional litigation and dispute resolution fora. Most recently, Prof. Muigai led the Independent Electoral and Boundaries Commission (IEBC) Legal Team in successfully arguing the Presidential Election Petition of 2022.
He is a Chartered Arbitrator of the Chartered Institute of Arbitrators (CIArb), United Kingdom and Kenyan chapters. Prof. Muigai is also a member of the Permanent Court of Arbitration (PCA) serving in the Second Term and a redesignate to the International Centre for Settlement of Investment Disputes (ICSID) panel of Arbitrators and of Conciliators. Currently, Prof. Githu Muigai is the Vice President of the London Court of International Arbitration (LCIA) African User’s Council.
He has over 35 years’ experience in handling arbitral proceedings domestically, regionally and internationally pursuant to various arbitration rules including but not limited to the PCA Rules, ICSID Rules, ICC Rules, UNCITRAL Rules, LCIA Rules, the CIArb Rules and the NCIA Rules. He is a member of the International Chamber of Commerce (ICC), Africa Arbitration Association (AAA), Kigali International Arbitration Centre (KIAC) and the Nairobi Centre for International Arbitration (NCIA) amongst several other leading international arbitration institutions around the globe.
On numerous occasions, Prof. Muigai has been appointed as either the President of the arbitral tribunal or as a sole arbitrator. He has also been retained as counsel for either disputing party in international arbitral proceedings. Over the years, he has been commended for his exceptional and extensive knowledge by institutions, parties and counsels. He was most recently recognized by The Lawyer Africa as Kenya’s Leading Arbitrator.
He is Professor of Public Law at the School of Law University of Nairobi (2005 to date). He served as Commissioner of the Constitution of Kenya Review Commission, (2000 – 2005), Judge of the African Court of Human and Peoples Rights (2007 – 2009), UN Special Rapporteur on contemporary forms of racism, racial discrimination, xenophobia and related intolerance (2008 -2011) and Vice-Chair of the UN Working Group on the Issue of Human Rights and Transnational Corporations and Other Business Enterprises (2018-2022).
