In a response letter addressed to advocates, Omwanza Ombati, Law Society of Kenya JSC Male Representative Candidate 2024 has lambasted his opponent and LSK President Eric Theuri and accused the incumbent of not doing enough to protect advocates interests in his role as member of National Council of Administration of Justice (NCAJ) especially by not opposing the Huduma Centre Judiciary Kiosks at proposal stage. According to Omwanza, the matter of Huduma Centre Judiciary Kiosks originated from NCAJ and Theuri as member of that Council could have done more to protect the interests of Advocates from the loss of business occasioned by the unfortunate administrative decision.
Here is Omwanza Ombati Statement on Remarks by POLKS on Huduma Kiosks verbatim:-
Dear Counsel,
When Advocates communicate, there is a duty to provide information that is accurate, factual and unadulterated. When I communicated to the membership on the Huduma Centre Judiciary Kiosks, this is exactly what I did, even though our colleagues found the information too factual to bear.
FACT: During this Council’s tenure, Advocates have lost business opportunities through systematic infiltration and watering down of the role of Advocates to wit:
- Through digitization, Advocates lost the niche of Conveyancing to Clerks and Cartels. The Ardhi SASA protest is a true reflection of the pain lawyers face, and I assure you the situation has not improved since the protest.
- The National Council on Administration of Justice adopted a decision to implement Huduma Centre Judiciary desks, which will severely mutilate the existing practice environment. iii. The services relating to the incorporation of companies, trusts, schemes and other corporate vehicles have been severely affected during this regime.
FACT: The President of the Law Society sits in the NCAJ, with a platform to raise serious policy concerns to protect the practice space for Advocates. This is a responsibility that requires tact and skill, and colleagues, we are in trouble because the current Council failed to take steps to prevent this eventuality.
FACT: Effective 2022, the Judiciary Huduma Centres Desks were rolled out, staff trained and effectively deployed for service at Huduma Centres. See the attached link where the Chair of the Implementation Committee provides context and factual information that must keep us worried: https://www.youtube.com/watch?v=Dto_f8ylzxU&t=552s
Colleagues, the Law Society of Kenya President keeps approbating and reprobating. He mentioned that the LSK was not involved, but nothing could be further from the truth. Sadly, Eric Theuri has elected to play politics in a serious situation where taking responsibility for inaction would have been the prudent thing to do.
My dear brothers and sisters in the struggle, it is impossible that the LSK was not involved in the roll out, or that a person who sits in the NCAJ was not aware. See attached Judiciary budget statement, a publicly available document: https://www.judiciary.go.ke/wp-content/uploads/2023/07/ Public-Hearing-2023-1.pdf
The above clearly delineates the priority funding areas. How can it be that the persons responsible for the profession remained oblivious? Mine is to ask genuine questions, for members to have discourse on. I will continue to agitate for competent representation, which members are entitled to. I leave it to you members to decide on the role of the LSK President who sits on the NCAJ, a platform through which the implementation of Huduma Kiosks originated.
Your Sincerely Omwanza Ombati,
Aspirant for JSC Male Representative for LSK
